Neighbors object but ZBA approves variances to allow motel/lodge conversion at 169 Route 214

The Town of Shandaken Zoning Board of Appeals voted to approve setback variances for a project at 169 Route 214 in Phoenicia that the applicant seeks to convert from a multifamily building to a motel/lodge. The clerk read the notice reopening the hearing; Pat McGahn, who said he lives nearby and was representing the owners, described current operation as short-term rentals and said the owners do not plan to host large events: "The plan is to continue to operate as is either one group up to 18 people... that's the only plan that we have," McGahn said.

Several neighbors and a written commenter objected. Longtime resident Maureen Millar urged denial and raised legal concerns, saying the proposed use risks spot zoning: "A special permit was never designed to facilitate this," she said. Board members discussed that the special-permit use itself is allowed in the district but that setback standards exist to protect neighbors. After discussion the board moved and, by roll-call vote, approved the requested variances. The approval will allow the applicants to pursue reclassification for business purposes; the board noted conditions and setback requirements would be recorded with the decision.
