The Town of Shandaken Zoning Board of Appeals approved an area variance for a deck-mounted handicap ramp at 2088 Upper Birch Creek Road, the board recorded during its July 15, 2026 meeting. Olivia, the clerk, read the legal notice for the application and Paula Dutcher, who identified herself as the contractor representing homeowner Carolyn Lazard, told the board the ramp will be attached to the existing deck as an accessibility improvement: "I'm a contractor... representing the homeowner Carolyn Lazard to build a handicap ramp off of her existing deck at her house," Dutcher said.
Clerk's materials list the parcel as 1.1 acres in an R-3/3-acre zoning district; the proposed deck sits roughly 32 feet from the front property line, and the variance was requested because the house is already close to the road. A motion to approve the variance was made, seconded, and carried on roll call; the board instructed staff to record conditions and enforce applicable setbacks when issuing the permit.
