Shandaken ZBA approves variance for handicap ramp at Upper Birch Creek Road

The Town of Shandaken Zoning Board of Appeals voted to approve an area-variance for a deck and handicap ramp at 2088 Upper Birch Creek Road during its July 15 meeting.
Paula Dutcher, a contractor representing homeowner Carolyn Lazard, told the board the project would add a handicap ramp to the existing deck. "I'm a contractor, and I'm here representing the homeowner Carolyn Lazard to build a handicap ramp off of her existing deck at her house," Dutcher said. The board had no substantive questions and moved to close the public hearing before taking up the variance during the regular meeting.
The clerk read the legal notice that the parcel is 1.1 acres in an R-3 district and that the applicant sought relief from setback requirements to construct the deck set back 32 feet from the front property line. The board then approved the variance on a roll-call vote recorded in the meeting minutes. Members recorded on the roll call included Gary Guilometti, Allen Bello, Ruby Hubert, Frank Cuevas and Jeremy Bernstein, and the vote on the record was five in favor, none opposed.
The board will include the variance approval in its minutes and the decision should be available in the municipal file for the property. Written comments had been accepted through the stated deadline and the public hearing record was closed as announced at the meeting.
