Law Director John Gasior told Council that Ordinance No. 66-26 continues a temporary moratorium on issuing and processing any special-use permits for assisted living facilities, nursing homes and independent-living establishments. He said the moratorium was largely driven by concerns raised by the Avon Fire Chief about the burden such facilities can place on the Fire Department and that the Administration intends to draft restrictive legislation, though that work has been delayed by competing priorities including the City Hall relocation and consideration of a second fire station.
Gasior said he is "optimistic" legislation could be before Council within the next six months, "if not sooner." Council did not raise questions during the work session. The moratorium remains in effect while staff develop proposed ordinance language and operational guidance.
