BZA approves fence in drainage easement at S. Fall Lake Drive with affidavit requirement

The Board un-tabled and approved Stephen and Madison Moore’s appeal to install a 4-foot black aluminum fence that would run to the tree line and encroach into a drainage easement at 4307 S. Fall Lake Drive.
Stephen Moore explained that aligning the fence to the official easement line would eliminate approximately 12 feet of usable yard and cut awkwardly across the property. Chair Ladegaard and staff said the city commonly grants such relief if the homeowner understands they must bear costs to remove and replace improvements if the easement is accessed. Acting Law Director Thomas Stringer noted Mrs. Moore’s signature must be obtained for the easement affidavit to be recorded with the Lorain County Auditor. The board approved the variance unanimously.
