The Avon BZA approved a request to formalize a lot split that had been acted on administratively in the 1970s but never legally recorded.
Zoning Enforcement Officer Jill Clements explained that the Church of God property had been functionally divided decades ago into two parcel numbers (one containing the church building and one with an existing house) but that the legal descriptions and deeds were never filed; the current request would record two legally recognized nonconforming lots under C.O.1282.03(d). Planning Commission approval was already contingent on the BZA's variance approval and the placement of deed restrictions that would prevent rebuilding if either structure were destroyed. The board approved the lot split unanimously; staff noted deed restrictions and recording with the Lorain County Auditor will follow.
Ms. Clements also placed on the record a neighbor concern about a fence location discrepancy, which she characterized as a civil matter between the neighbor and the church and unrelated to the variance approval.
