Council extends emergency measures to ensure special education for young adults in DOC custody
Summary
The Council unanimously approved emergency legislation (PR26‑764 and Bill 206734) to continue designation of DOC as the agency responsible for providing FAPE and to extend provider contracts through the current school year while permanent law completes congressional review.
The Council approved emergency extensions to preserve the delivery of special education and related services to eligible young adults in Department of Corrections custody.
Councilmember Pinto explained that under IDEA and district law, eligible students in DOC custody must receive a Free Appropriate Public Education (FAPE). A temporary contract with Maya Angelou Public Charter Schools had expired after school year 2022–23; emergency measures ensure DOC remains designated to provide those services for school years 2025–26 and 2026–27 until the permanent LEARNDS amendment completes congressional review. Pinto said the task is to avoid gaps in educational services and to allow the existing contract to continue.
