City attorney seeks authorization to assign Hollowbrook Dam repair contract to parent company after insurance lapse

The City Attorney briefed the Council on the Hollowbrook Dam repair contract and a proposed assignment and assumption agreement. The contractor named on the contract, ConTech Construction Technology Inc., was reportedly unable to renew required insurance; the parent company, ScapeTech Landscape Technology Inc., dba ConTech Construction, offered to assume the contract and provide the insurance and indemnities the city requires.
City Attorney (unnamed) said the parent company would take on "all the responsibilities under the original contract, assume all the obligations under that contract, including the provision of the insurance and the indemnity provisions that are associated with the contract." He asked the Council to authorize a resolution on Aug. 18 to approve the assignment and assumption agreement so repair work can continue under the parent's insurance coverage. Council asked staff to confirm progress on repairs and to ensure the water department and project manager are satisfied with performance before approving the assignment.
