Clay board adjourns NexAmp battery-storage hearing as moratorium, code questions linger

Olivia Sproviero, speaking for NexAmp, told the Town Board that the Wetzel Road Battery Energy Storage System application had been updated to conform with Clay's newly established battery code and that the company wanted to proceed within that framework. "They have put a lot of time into this already," Sproviero said, urging the board to advance review rather than start the application over.
Commissioner of Planning & Development Brian Bender said the town is still in the middle of a six-month moratorium on new BESS applications and warned the board that staff already has multiple applications in limbo. "The moratorium began in April and would end in October so perhaps they could accept applications in September," Commissioner Bender said, noting unresolved questions about maximum number of installations, who bears review costs, and how much grid capacity new projects would consume. The Board voted to adjourn the public hearing to August 17, 2026; the motion carried 5–0.
