Board weighs tightening and simplifying interdistrict transfer rules for split parcels

District staff and outside counsel presented a months‑long review of "split parcels": properties bisected by the city line where a portion of a residential parcel lies in Piedmont and the remainder in Oakland. Staff estimated about 75 split parcels along several border streets and said parcel boundaries — often established decades ago around sewer lines — have created enrollment ambiguities.
Legal counsel explained case law (Katz) supports the view that when a parcel line runs through a residence, the portion that includes the home can be treated as a resident address for the district. Based on that analysis, staff recommended eliminating the current Priority 7 interdistrict transfer status (which required an IDT) and guaranteeing PUSD enrollment for parcels where the residence is in Piedmont. They also recommended moving Priority 9 into the same category as Priority 6 and eliminating an obsolete Priority 2 requirement that juniors and seniors who move obtain an IDT.
Board members asked staff to return a revised board policy and administrative regulation for a first reading with supporting data on how many addresses and actual students would be affected. Several members supported the direction as a practical way to reduce paperwork and increase resident enrollment; staff said they would research historic attendance data for the affected parcels and return recommended redrafted language.
