The New York State Board of Elections adopted a formal opinion concluding that contributions made in cryptocurrency may be accepted and should be recorded and disclosed as in-kind contributions, with valuation taken at receipt. Counsel said the recommendation tracks Federal Election Commission guidance and lays out that existing contribution limits and disclosure obligations apply.
Counsel summarized the opinion as broadly consistent with federal guidance, saying the cryptocurrency "is permitted, as a contribution." The opinion directs committees to record the fair‑market value of the contribution at the time it is received and to provide the disclosures required for in‑kind donations. Counsel added the board "reserve[s] the right to develop additional reporting requirements" if the technology or practice evolves.
Commissioners moved and adopted the formal opinion at the meeting. Counsel and staff said there is no contemporaneous package of new regulations tied to the opinion; any additional reporting or guidance would be considered later as the agency and stakeholders monitor practices and implementation.
