The Monte Sereno Planning Commission on a unanimous recommendation asked the city council to approve a site development permit to legalize an existing detached accessory structure at 1557 Kevin Lane.
Staff described the application as "an application for a site development permit for a detached accessory structure and is approximately 200 square feet at 1557 Kevin Lane," and recommended approval with standard conditions attached to the staff report. Staff told the commission the structure was constructed without proper permits and that the site development permit would be the first step in legalizing it; a building permit and more detailed construction drawings would be required at the building‑permit stage.
Commissioners focused their questions on the plan details, setbacks and whether the structure would be an accessory dwelling unit; staff said the proposal is not an ADU and that standard permit conditions would include permit expiration, limits on construction hours and exterior materials that match the plans. No members of the public rose to speak during the public hearing and the commission closed the hearing before taking a recommendation vote.
The recommendation means the property owner must submit formal construction plans and obtain a building permit to complete legalization; the city council will make the final determination. The staff report and discussions recorded by the commission note that materials, setbacks and any required corrections will be addressed in the building permit review.
