Marquette County board grants FOIA appeal, orders release of portions of aviation fuel contract
Summary
By a 5-1 vote, Marquette County commissioners granted an FOIA appeal from Mr. Sibley and directed staff to provide portions of the countys aviation fuel contract that had been redacted. Civil counsel advised the board that vendor-imposed conditions on disclosure would effectively deny a FOIA appeal, so the county must release the information unconditionally.

Marquette County commissioners voted 5-1 to grant a Freedom of Information Act appeal from Mister Sibley and to provide him with the portions of the countys aviation fuel contract that had been redacted by the vendor.
Mister Sibley told the board he challenged the redactions because the public has a right to know contract terms for a publicly owned airport. "Chairperson, commissioners, thank you for the opportunity to speak regarding my FOIA appeal concerning the oil agreement at Marquette County, Sawyer Regional Airport," he said. Civil counsel Alex told the board that conditioning disclosure on vendor terms would defeat the FOIA process: "It would be effectively a denial of the appeal, because it wouldn't be disclosing the information unconditionally. There's no provision for conditions." The clerk recorded the roll call as five in favor and one opposed (Commissioner Malone), and the chair instructed staff to deliver the unredacted material to Mister Sibley.
