The Spencer County Fiscal Court voted on July 20 to rezone a 2.442-acre tract on Cecil Noel Road owned by Teddy and Donna Noel from AG‑2 (agricultural) to amended R‑1 (residential).
The Planning & Zoning Commission recommended the change at its June 4 meeting, noting that the county comprehensive plan's future land‑use map supported low- to medium-density residential development and that HB160 (effective 7/1/2026) would allow a qualified manufactured home in R‑1. Administrator Ashlee Welch presented the planning commission's recommendation to the court. On second reading the ordinance was approved "on motion of Esq. Cotton, second by Esq. Pharris," with all members present voting "Aye" and Esq. Stump absent. The minutes reflect the formal adoption in the public notice portion of the record.
The court record and submitted plat show the parcel as Tract 2 (2.442 acres) on Cecil Noel Road. The Planning & Zoning record attached to the minutes notes the commission's findings of fact and states the change complies with the comprehensive plan. The rezone may allow either a stick-built home or, under HB160, a qualified manufactured dwelling on the lot.
The court did not attach additional conditions to the adoption beyond the planning commission recommendation. Next procedural steps are administrative: the clerk will update the county zoning map and record the ordinance per standard county practice.
