Town of Marlborough adopts zoning changes to allow senior citizen housing cluster developments

The Town of Marlborough Town Board voted unanimously on Feb. 24, 2025 to adopt Local Law No.1 of 2025, changing the town zoning code to permit senior citizen housing as a special use in the Highway Development (HD) district.
The law revises the definition of "Senior Citizen Housing" and adds a new Section 155-29.3 allowing applicants to seek a residential cluster development that provides senior housing with units of two bedrooms or fewer served by municipal water and sewer. The law sets a minimum project area of three acres, a lot width minimum of 200 feet, and a maximum density of eight units per acre.
The board also amended mixed-use provisions so that more than one residential unit will be considered compatible with other uses only in the C-1 and C-2 zones, while carving out exceptions for senior citizen housing. The Town Board filed a SEQRA Negative Declaration before adoption, finding the change would not cause significant environmental impacts.
"The proposed legislative amendments included in this action are not inconsistent with the existing Comprehensive Plan of the Town of Marlborough," the board's SEQRA finding states. The resolution recorded the vote as: Supervisor Corcoran Yes; Councilman Molinelli Yes; Councilman Cauchi Yes; Councilman Zambito Yes; Councilwoman Sessa Yes.
The law takes effect upon filing with the New York State Secretary of State; the town clerk will file the certified original and a copy as required by statute.
