Burger King requests minor site-plan amendment; board may act Aug. 20

Craig Tripp of GPI presented a site-plan amendment for a recently approved Burger King project during new business on Aug. 6. Tripp described a reduction in site-scope work intended to lower construction costs: renovate the existing dumpster enclosure rather than build a new one, shift the second drive-through lane about 8.5 feet north, and relocate landscaping and parking islands accordingly. He said the amended proposal would result in a net of 43 parking spaces, which he said remains above the Code-required minimum.
Tripp asked the board to consider acting on the amendment at the Aug. 20 meeting, but town counsel reminded the board that action on new business typically requires placement on a regular agenda and that the planning board has discretion to require or waive an additional public hearing. Counsel noted that the prior SEQR negative declaration could still be relied upon if the board finds the amendment is not materially different or more intensive than the previously approved plan. The applicant agreed to submit full, updated plan sets to the building department and requested the board include the item on the Aug. 20 agenda for possible action.
