The Town of Marlborough Town Board on Feb. 10 approved extending the Town of Marlborough Water District to include parcels tied to the proposed Marlborough Resort (St. Hubert’s Lodge and Club properties) and authorized a contribution agreement requiring the project owner to fund on‑site improvements and a $600,000 contribution to the water district.
The board also adopted a State Environmental Quality Review Act (SEQRA) Negative Declaration finding no significant adverse environmental impacts from the extension after review of the owner’s Map, Plan and Report and Short Environmental Assessment Form parts. The extension was described by parcel numbers and adopted by recorded vote with Supervisor Corcoran, Councilperson Cauchi and Councilperson Zambito voting Yes (Councilpersons Sessa and Molinelli absent).
Under the Water District Contribution and Capital Expenditure Agreement approved by the board, Marlborough Resort LLC will design, permit and construct required on‑site water improvements and pay a total Contribution of $600,000, payable in three installments: $200,000 upon issuance of a building permit or connection to the district, a second $200,000 within 18 months of the first payment, and a final $200,000 within 36 months of the first payment. The agreement requires the owner to deposit an initial escrow of $7,500 to defray town legal and engineering review costs and subjects the extended district to contingencies including non‑appealable site‑plan and building‑permit approvals.
The resolution and agreement reference Town Law Article 12 procedures for water‑district extensions and specify that the improvements described in the Map, Plan and Report (Passero Engineering Architecture, Sept. 16, 2024; revised Jan. 9, 2025) be constructed when funds are available. The agreement also permits the Town to void the extended district if the owner does not make the first payment within 24 months of execution. The board voted to authorize the Town Supervisor to execute the agreement on the town’s behalf.
