The Village of Cherry Valley Planning and Zoning Commission unanimously approved a variance on Aug. 20, 2025, allowing an accessory structure at 713 Clayton (PIN 16-01-403-005) to exceed the 15-foot maximum height by 7 feet. Commissioner Bill Lawson moved to approve the request and Commissioner Jim Smetana seconded; the roll-call vote was 7–0 in favor.
Attorney Aaron Szeto read the Findings of Fact (A–F) supporting the petition, including that "because of the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result" if the strict letter of the code were applied, and that the variation would not be detrimental to public welfare or injure neighboring property. Each finding was recorded as 7–AYE, 0–NAY.
The Commission's action approves an additional 7 feet over the code's 15-foot accessory-structure height limit, effectively allowing a maximum height of 22 feet for the accessory structure at the address specified. Commissioners recorded that the request met the ordinance standards for uniqueness of conditions, lack of exclusive economic purpose, and consistency with the spirit and intent of Chapter 82 (Zoning).
Commission documents state the item will be forwarded to the Committee of the Whole on Aug. 25, 2025, with a favorable recommendation from the Planning and Zoning Commission. Minutes were recorded by Deputy Village Clerk Heather Riley.
