Burton council fails to enact subdivision ordinance after public hearing
Summary
After a public hearing in which residents voiced concerns about impacts on small lot owners and utility capacity, the council voted 3–2 against enacting the proposed subdivision ordinance (AYES: Kalkhake, Tidwell; NAYS: Gilmon, Eckhardt, McLaughlin).
The Burton City Council considered an ordinance to govern subdivision of land Feb. 11 but the motion to enact and approve the ordinance failed. Mayor Karen Buck explained why the item was back on the agenda and that another public hearing had been published. Councilmember Macey Tidwell moved to enact the ordinance; after members stated their positions the roll call was AYES: Nathan Kalkhake and Macey Tidwell; NAYS: Tommic Gilmon, Jeff Eckhardt and Paul McLaughlin — the motion failed.
During the earlier public hearing several residents objected or sought narrower definitions to limit the ordinance's reach. Berneake Gantt asked whether Council knew the will of the community; Susan Tommaney said small-lot owners might lose the freedom to build; Ned Ross warned that the city’s inability to provide utility services could prevent large-scale development. The council then removed a related subdivision fee schedule because the ordinance did not pass.
