Board pushes for restoration surety, hears $300,000 estimate for Beta projects

The Development Review Board considered whether to require a financial surety to guarantee completion of earthwork and site restoration related to two Beta Technologies applications (SB2615 and MS2601).
Applicant engineer Chris Gendron told the board he provided a restoration estimate and can work with the director of Public Works to finalize numbers. In the hearing record, the applicant identified approximate restoration costs of $250,000 for topsoil and seed and $50,000 for paving, for a combined estimate of $300,000. The applicant said the total can be broken out across parcels and that the estimate would be reviewed with Public Works before finalizing any surety amount.
Board members discussed options — a bond or letter of credit, an escrowed amount, or a recorded restriction that triggers contribution at the time of sale — and staff reported legal and Public Works concerns about tying contribution timing to a future sale rather than to permit issuance. Several board members favored a condition that would prevent development on subdivided lots until the road or required work is completed, or otherwise require construction/contribution at time of sale or subdivision as a clear trigger.
The board closed both hearings and instructed staff to work with the applicant and Public Works on precise surety language and the timing/trigger for any required financial assurance.
