Counsel advises separate events for incumbents at "Coffee with Candidates"; board debates Sunshine Law risks

Chair Kathleen Lonergan read District Counsel's written response on a proposed "Coffee with Candidates" event and the board debated whether further action was needed.

"If any incumbent Supervisor is interested in participating they will need to ensure compliance with the election code and I think it would be a fair request for them to ask them to arrange separate events per seat to avoid any potential Sunshine Law violations," Lonergan read from counsel's email. Vice Chair Arthur Rhodes said "our guy" would not attend based on that interpretation of the campaign and Sunshine rules. Members noted the Florida Election Commission enforces complaints but does not provide advisory opinions.

The board discussed differing legal views, including an HPCA attorney opinion that differed from District Counsel's interpretation and references to Florida Statute and Sunshine Law implications for elected officials attending candidate events. No formal motion was made on the matter during the meeting; the reading of counsel's guidance was treated as the official response and board members were advised to consider separate, seat-specific events if incumbents participate.

The matter remains informational: board members debated next steps and a recommendation to consult the Florida Election Commission or seek further written advice before scheduling any event that includes incumbent supervisors.
