Following a closed executive session, the Board reconvened Sept. 9 and unanimously approved a lease agreement and a real‑estate contract with the City of Brownsville related to the Cummings property. Both approvals were presented as pending a final legal review and passed 7–0.
Board Attorney Nick Maddox advised trustees the contract includes a provision allowing the city to recapture funds if the district does not use the proceeds exactly as contemplated in the agreement — a "snap back" mechanism designed to protect the city’s intended public‑use outcomes. Trustees requested that legal counsel complete a final review of contract language, and the Board approved both actions with that caveat.
The approvals follow earlier public discussion and the amended interlocal agreement clarifying a potential city sale and a leaseback to allow ongoing CTE operations while a replacement facility is planned. Trustees emphasized transparency and community reassurance that the Cummings parcel will not be used for hotel or commercial retail uses tied to park‑funding constraints.
