Mr. Gulick and staff told the council the city’s 2017 ADU ordinance needed updates after recent state changes and an HCD letter identifying conflicts. Staff summarized key changes: clarified statutory definitions; established new state deadlines (staff must notify applicants of missing items within 15 business days and approve or deny ADU applications within 60 days); clarified how ADUs, JADUs and ADU conversions are counted on single‑family and multifamily lots; adjusted maximum heights for attached and detached ADUs; and removed some local owner‑occupancy or size limits inconsistent with state law.
Staff illustrated typical scenarios: single‑family lots may have a main house, a JADU and a detached ADU (up to four units total in some configurations), existing multifamily sites may convert up to 25% of onsite units into ADUs, and new multifamily construction may include up to two detached ADUs under state rules. On review timelines, staff and the city attorney explained that state law requires business‑day deadlines for completeness reviews while the city’s standard appeal window uses calendar days; if a statutory deadline falls on a weekend the timeline is extended to the next business day.
Council members praised staff and noted Temple City has permitted many ADUs in recent years; they also raised parking concerns when garages are converted to living units and suggested staff return with follow‑up options on parking enforcement and overnight permits. A council member moved to introduce Ordinance No. 26‑1087 by title only, the motion was seconded and approved by roll call, and the clerk read the ordinance title into the record.
