Doraville commission recommends easing ADU rules after staff says no permits pulled since 2025 ordinance

The Doraville Planning Commission voted to recommend a text amendment to Section 23-61.3 that would reduce permitting barriers for accessory dwelling units (ADUs).
City planner Albert explained the revision would allow property owners to submit architect-stamped custom plans rather than being limited to preapproved city plans or pursuing a council variance. "The idea here is to remove the variance requirement and to require people submit a set of plans that an architect has designed," Albert said. Albert also told commissioners that "the number of ADU permits pulled since May 2025 is at 0," arguing the variance process is deterring applicants.
Commissioners pressed staff about existing unpermitted ADUs and enforcement: staff said such units generally must go through the variance process, submit architect-stamped plans and a survey, and meet setback and height rules. Staff clarified duplex rules, noting R1 does not allow duplexes, R2 does (the city currently has no R2 zones), and T3 does allow duplexes. Staff said owner-occupancy is enforced by an annual affidavit; false statements can lead to fines or imprisonment.
The commission opened the public hearing; no speakers testified for or against the amendment. A motion to recommend approval of case A-26-05 passed on roll call with the commissioners recorded as voting yes for those names shown in the transcript. Staff did not present a final effective date for the text change during the hearing.
