The Board approved designating three deputy district attorney positions as critical labor‑shortage positions under PERS rules (NRS 286.523), a measure intended to broaden the pool of applicants by allowing retired attorneys to be hired without PERS post‑retirement earnings limits.
Kim Brown Sema, human resources, explained the county has had persistent vacancies in these roles since December 2025 and staff recommends the designation to improve recruitment. Arthur Mallory, district attorney, supported the request and said the designation could allow the county to hire qualified retirees and save on certain pension‑related costs. Mallory noted retention and commute challenges have contributed to vacancies.
Commissioners debated whether recruitment or retention reforms were the primary problem; one commissioner questioned whether the designation would address turnover and urged stronger recruitment efforts. The motion to designate the positions passed with a recorded outcome of 2 to 1. The designation is effective 08/17/2026 and staff said it will remove post‑retirement earnings limitations for targeted hires under PERS criteria.
The board discussed monitoring the approach and continuing active recruitment for permanent hires alongside any short‑term retiree hires.
