David Desmond told the Zoning Board that rising deer numbers and ongoing feeding by a neighbor prompted the application for an 8-foot deer-exclusion fence. He said the situation escalated despite his requests to the neighbor and after contacting the New York State Department of Environmental Conservation; "The DEC also told the neighbor to stop feeding the deer with no success," Desmond said, describing unsuccessful attempts to halt the feeding.
Desmond provided supporting materials including neighbor sign-offs, photographs of the proposed fence locations, a sample fence image and DEC fence-height guidance. The board treated the neighbor-feeding claim as part of the factual basis for the hardship; however, no other speaker at the meeting disputed or independently corroborated the account. The ZBA approved the variances with conditions requiring adherence to a certified survey and Village approval of fence materials.
