Shoreham ZBA approves 8-foot deer-exclusion boundary fence at 23 Ashley Lane with conditions

The Village of Shoreham Zoning Board of Appeals voted 4-0 on Jan. 21 to approve area variances for David and Maureen Desmond at 23 Ashley Lane that permit a deer-exclusion fence as a boundary fence and allow the fence to be 8 feet tall where the zoning code caps boundary fencing at 6 feet. Village Attorney Brian Egan read the boardapproval statement and the motion passed on a roll call vote of Madigan, DeSario, Alessi and Butler.
At the hearing, applicant David Desmond provided a handout that included signed neighbor statements, photographs of his backyard, a certified survey and DEC guidance on fence height. Desmond described the property as a lower-elevation flag lot and said the fence placement would not block neighbors' views. "the deer population has increased significantly in the last 10-15 years and on any given day over 20 plus deer come through his property," Desmond said, citing repeated deer presence as the reason for the requested relief.
The board approved the variances subject to two conditions stated in the approval: (1) the installation must follow the Pinnacle Land Survey dated Oct. 15, 2021, last updated Dec. 2, 2024; and (2) the fence material must be black galvanized metal posts and black galvanized metal fencing, with final material submission and approval by the Village. The board discussed using the same or similar conditions the ZBA applied to a prior 2021 application at 18 Ashley Lane.
Marc Alessi made the motion to close the public hearing and grant the application; David Madigan seconded. The vote was recorded as Madigan yea, DeSario yea, Alessi yea, Butler yea. The board adjourned at 6:58 p.m.
