Fernley council affirms it will not negotiate water-right dedications from developers

The Fernley City Council voted 4-0 to adopt a resolution affirming that the council will not negotiate water-right dedications required by the development code. Michelle Rambo, interim chief development officer, said staff have seen a "new trend" of developers requesting to dedicate fewer water rights than code requires and that the resolution will provide a formal document for staff to present to developers to reduce repeated, inconsistent requests.
"We staff well, council has been very clear with staff that we do not negotiate water rights," Rambo said, explaining the rationale for the resolution. Councilman Hammond moved to approve the resolution and Councilman Torres seconded; the motion carried 4-0. Staff will distribute the resolution as a formal notice to developers and update internal guidance to prevent ad hoc negotiations.
