Board grants side-setback variance for accessory structure on West Division Road

The Board of Zoning Appeals voted Aug. 5 to grant a variance allowing an accessory structure at 1006 West Division Road to set the building roughly 14 feet from the side property line instead of the 20-foot side-setback required under the I‑1 light-industrial district rules.
Petitioner Ashley Lincoln told the board the property is situated in a residential neighborhood but is zoned I‑1 and that the accessory structure is a personal project rather than a business. “We are asking for a 10 foot setback instead of the 20 foot setback from the I 1,” Lincoln said, identifying the reduced setback she requested (later clarified in findings as approximately 14 feet). Board members questioned whether materials would match the house; Lincoln said the planned color would be gray rather than white and that the structure would fall within residential patterns.
No members of the public spoke on the application. The board moved, seconded and carried a motion to approve the variance with the exact 14-foot figure added to the written findings. In its findings the board stated the variance would not substantially harm public health, safety or the value of adjacent properties and that a strict application of the ordinance would create practical difficulties for the property owner.
The board closed the public hearing and approved the variance; staff will include the measured setback and drawings in the record.
