The Brightwaters Village Board voted to adopt Local Law No. 1-2025 to override the state tax cap after a public hearing and board discussion.
The mayor explained the procedure for overriding the cap, saying the state cap is "roughly 2%" and that the village is working on a budget to be published online in about two weeks. He noted that "the fire department raised us up $44,000 this year. That $44,000 is our 2% right there," using the example to show how quickly the available margin can be consumed. Board members then opened the floor to residents during the public hearing.
A resident identified only as Rich urged the board to consider allowing marijuana retail in the North Business District to generate revenue, saying such sales had materially increased receipts in neighboring areas and might reduce pressure to exceed the cap. The mayor asked village staff and counsel to research whether the village could limit retail to the North Business District and to report back to the board. A trustee cautioned that opting in carries a long-term commitment: once a municipality opts in it cannot opt out, and the board would need to confirm statutory rules before acting.
After discussion the board moved to adopt the local law and approved it by voice vote. The board scheduled the budget hearing for next month and said the tentative budget would be posted online in about two weeks for resident review.
