Sarah Campbell represented the applicant Amber Johnson and outlined a small retail plan for natural crystals and smoking accessories in a 385-square-foot ground-floor space at 88 Robinson Street. Campbell pushed back on several staff report items she called inaccurate, saying the applicant was fined but never criminally charged and that prior operations at a different location involved gifting practices that were common at the time.
Commission members raised a range of concerns relevant to land use and enforceability. One member said the zoning officer had been denied entry previously and noted that a location operated as a private club would represent a different use than general retail. A planning staffer summarized the regulatory standard: if more than 25% of floor area is devoted to smoke- or vape-related products the location could qualify as a smoke shop and be treated differently under the code.
“Look at it. I’m just telling you what I was told… she did deny access,” Campbell said when asked about the earlier on-site interaction with a zoning officer; staff later said the zoning officer was told the location was a private club during that visit. The commission requested that the applicant provide an interior plan showing the percentage of floor area dedicated to accessories and confirm whether vape products would be sold. Commissioners voted (5–0) to schedule a public hearing so the full facts and any public comment could be taken into account.
