Commissioner says hemp licensing transfer to ABC remains in progress amid litigation

During committee questioning about recent statutory changes, Commissioner Andy Holt told members that the legislature directed moving the hemp licensing program from the Department of Agriculture to the Alcoholic Beverage Commission (ABC) but that the department continues to face pending litigation related to hemp regulation. "The General Assembly did give us a dictate to transfer the hemp program from the department to ABC, and we're currently in the process of making that transition," Holt said. He said pending litigation constrains how much detail the department can provide at the hearing.
Members asked for a follow-up on how many legacy licenses remain with the department and what the near-term expectations are for completing the transfers. Holt said the transfer remains the direction of the General Assembly and that the department is facilitating that transition while working with its legal team to complete the change.
