Summary

The Buncombe County Board of Adjustment approved ZPH2026‑015 on June 10, allowing Timmy and Tammy Penley to split a 0.74‑acre parcel at 125 Little Spud Lane into two lots smaller than the 30,000 square‑foot minimum.
Tim Penley, who identified himself and described his history as a builder, said the homes on the parcel were built before the 2009 zoning minimums and explained the family’s retirement‑planning reasons for selling one house while passing another to their daughter. Planner Jason Payne told the board the property is on septic and well and that the proposed resultant lot sizes are 15,981 sq ft and 16,140 sq ft. No witnesses appeared in opposition; the board found the hardship results from conditions peculiar to the property and adopted findings of fact, approved the variance, and ordered the granting of the permit on the record.
Why it matters: the approval allows an existing arrangement of legally nonconforming homes to be transacted and creates two individually titled parcels; the board noted previous variance approvals on nearby similar parcels and emphasized that the lots were constructed prior to current lot‑size rules.
