Plan Commission approves Foxwood (Walnut Trails Phases 3–4) preliminary plat over neighborhood objections

The Elkhart City Plan Commission voted to approve a preliminary plat for the Foxwood section of Walnut Trails Phases 3 and 4, a proposed 38‑lot subdivision on roughly 9.99 acres, during its Aug. 13 meeting.

Planning staff presented the application and recommended approval. Eric Trotter, senior planner, told the commission that “the city planning staff has reviewed the subject petition and recommends approval of the preliminary plat for a 38 lot, plus or minus 9.99 acre major subdivision to be known as the Foxwood section of Walnut Trails 3 And 4.” Trotter said the proposal meets zoning and subdivision ordinance standards but listed minor outstanding items — primarily the recording of retention and stormwater easements and final engineering — to be handled before final plat approval.

Petitioner Tim Sailor of Innovative Communities said the site is the approximately 10‑acre final piece of a long‑running development and urged preliminary approval, adding that “it was always intended to be developed in this way.” Commissioners asked technical questions about sidewalks, minimum lot sizes and which lots meet R1 versus R2 standards; staff confirmed sidewalks and curbs are required and that some lots meet the R2 minimums.

After discussion, Commissioner Mishler moved to approve the preliminary subdivision plan and adopt the staff report as the basis and conditions of approval; the motion passed on a roll‑call vote with commissioners voting in favor. Chair noted the approval is primary/preliminary only; the final plat and any remaining engineering and permitting items will be reviewed by staff and the plat committee before permits or sales occur.
