Committee focuses on safety: setbacks, NFPA standards and decommissioning bonds

Committee members pressed the clinic on public safety, setbacks, and how to ensure projects are decommissioned at the end of their useful life. Kurt stressed that setbacks and clear conditional-use factors are among the ordinance's principal tools to protect neighboring properties and to create defensible grounds for denial when appropriate.
"For instance, setbacks are are an issue with big batteries," Kurt said, adding that some developers in other regions seek several hundred feet and that the town should consider requiring independent consultant review paid by the applicant where safety or engineering questions arise. He recommended drafting factors that allow the town to require additional fire suppression, hydrants or equipment based on an independent analysis.
Kurt also highlighted decommissioning bonds as critical protection: he said the bonds are often annually renewable and that bond amounts should be revisited periodically to reflect rising costs. "They go for a year," he said, describing how many decommissioning sureties operate in practice. The clinic suggested including explicit language on bond timing and revisits in the draft ordinance so the town is not left with unrecovered hazardous materials or abandoned infrastructure.
The committee asked the clinic to include NFPA standards, independent consultant requirements and model bond language in its draft so the town and its fire department can evaluate appropriate equipment and response needs.
