The Planning Commission recommended that the City Council adopt zoning code amendments designed to bring Placentia’s ADU and JADU rules into compliance with recent state legislation.
City staff explained that changes to state law have increasingly limited local discretionary review of ADUs and that the proposed ordinance (PMC chapter 23.73) clarifies ministerial-review procedures, updates definitions and adjusts development standards such as maximum unit size, height and setbacks. Staff said the draft attempts to preserve as much local control as state law permits; for example, the ordinance allows front‑yard ADUs where necessary but is drafted to "push them in the back" when feasible and to limit encroachment into required setbacks.
Commissioners pressed staff on how the amendment treats previously unpermitted ADUs. Staff said the draft provides that an application for an ADU or JADU constructed prior to 01/01/2020 cannot be denied solely for lack of prior permits; the owner may seek to legalize the unit but must correct building‑code or health‑and‑safety violations. Staff noted the city can require inspection to determine whether a structure is substandard.
After questions about parking, occupancy limits (governed by fire and building codes) and the likely rate of ADU production, the commission voted to forward the draft ordinance (resolution PC 2025-04) to city council for consideration.
