Board hears explanation of manifestation-determination process and 10-day suspension threshold

District special-education staff reviewed how the district conducts a manifestation-determination review when disciplinary removals may change a student’s placement.
"When a student with a disability violates the code of conduct, they are also subject to disciplinary action," the presenter said, and explained the committee examines IEP implementation, evaluations and the behavior that led to discipline to determine whether the conduct was a manifestation of the disability. The presenter noted that the process is triggered when removals add up to or exceed 10 school days: "10 is the number. We have to hold a meeting. We have to conduct a meeting. We have to make a determination."
Board members asked whether the district follows a formalized process before day 10; the presenter said the district performs case-by-case consultations and early interventions and that a pattern of repeated suspensions (for example a five-day suspension) often triggers internal review before the 10-day threshold. The presenter also explained that if the committee finds deficiencies in IEP implementation, the district must correct those deficiencies and can add services (for example expedited evaluations or counseling) even if the behavior is determined not to be a manifestation.
