City staff presented a quasi-judicial staff report seeking to vacate 10 feet on the east and west sides of North Cherry Street between Cove Avenue and East Penn Avenue to return that land to adjacent property owners.
Planning staff (speaker 21) described the right-of-way as an 80-foot corridor with narrow paved roadway and gravel shoulders; staff recommended narrowing it to the city standard of 60 feet should the vacation be approved. The applicant has completed outreach and secured about 70% consent from adjacent owners, which staff said meets the process threshold required to consider a vacation.
Council and staff clarified that vacating the ROW would transfer ownership back to adjacent property owners, likely prompt property-tax reassessment for increased lot area, and requires written consents and adherence to Oregon land-use rules. Staff and applicants confirmed that some adjacent property owners did not consent to a full-block vacation, so the requested action limits the vacation to the consenting portion.
The council opened testimony and will continue the quasi-judicial hearing to Sept. 2, 2026, to allow the record to be completed and for any additional evidence or written comments to be submitted per the hearing procedures.
