Committee defers Auerbach amendment as Madden Creek bid and bond timing shift

Sarah Busan Johnson, director of engineering, told the committee that the district will not award the Madden Creek Water System Improvement Project Phase 4 at the March board meeting and is removing the related Amendment No. 2 to the Auerbach Engineering professional services agreement from the packet.
"We are anticipating opening bids for Madden on Monday," Johnson said, and added the item "will accompany the award of the Madden construction bid." She said the district is adjusting the timeline because of changes in financing and the timing of the bond sale.
Committee members pressed staff on whether the board could award the $8,000,000 construction contract before bond proceeds were in hand. Staff noted federal procurement constraints, including "Buy American" provisions, that affect the schedule and stressed the tradeoffs between starting procurement early and ensuring funding is available. Will, a district staff member involved in financing, said the financing team "feels very confident they will sell bonds" but that the team is balancing that confidence against timing risks.
The committee agreed to defer formal action and to bring the Auerbach amendment back to the board, likely in April, when financing and the bid-award schedule are clearer.
