Before adjourning the public portion, a board member moved — and the board voted — to enter executive session under the Open Public Meetings Act to discuss current pending litigation and potential litigation matters.
"The board is going into executive session in accordance with the provisions of the open public meetings act of state of New Jersey to discuss current pending litigation as well as potential litigation matters," a staff member said. Board staff also stated the board would not take any action after executive session during the public portion.
The meeting recording was stopped for the executive session and certain attendees were excused; the transcript shows no public deliberations or decisions after that announcement.
