Parents cite AB 2444 as Monterey County board grants transfer for two children

Angelie Berndie told the Monterey County Board of Education she and her husband were asking the board to let their children remain at Touro Park School in the Washington Union School District for continuity and childcare stability.
"My name is Angelie Berndie, and I'm here with my husband, Ryan Berndie. We are here today regarding our interdistrict appeal for our children, Lila Berndie, who's entering 3rd grade, and Maxwell Berndie, who's entering 1st grade," she said, arguing that AB 2444 and Education Code protections prevent required annual reapplication for students already enrolled under interdistrict agreements.
A Salinas City Elementary School District representative said the district respected families' needs but that the Berndies' circumstances did not meet the district's current criteria for out-of-district transfers, noting the parents live within walking distance of the district residence school and that the district offers before- and after-school supports.
Trustee John McPherson moved to grant the appeal, citing the Education Code and the parents' documentation; the board approved the motion by unanimous voice vote. "I hereby move that student 252634 and 252635 shall be allowed to attend the Washington Union School District to the highest grade offered by the school in which they are enrolled," he said.
Board staff will send formal notifications of the decision to the parties and the district and will follow up with counsel and scanned documents as requested by trustees.
