Council staff introduced a request for a local proximity waiver that would allow Silverside Deli, a restaurant at 2122 South Highland Drive in District 7, to receive permission from the city before the Utah Department of Alcohol Beverage Services can issue an on‑premise retail license. Austin Kimmel, council policy analyst, framed the item and explained the new legislative process requiring council approval of proximity waivers and a public hearing with a 30‑day waiting period before the council may approve a waiver.
Planning staff answered council questions about measured distances between the proposed restaurant and the nearby library. Arturo, a planning presenter, said the direct pedestrian path from the library to the restaurant entrance “is approximately 389 feet, which exceeds the requirement in Utah code,” but that a straight‑line measurement is about 90 feet and therefore “short by a 110 feet.” Arturo told the council that the planning division “finds no impact to the library if the straight line waiver is approved.” Staff and council members noted neighbors will be notified and that the public hearing is required; council may not decide the waiver until at least 30 days after that hearing.
