Sun Valley council votes to annex Lane Meadows, sets 10‑business‑day deadline for waiver and development agreement

The Sun Valley City Council voted unanimously on June 2, 2014 to annex the Lane Meadows property under ANNX 2013-01, with conditions requiring execution of a waiver and a development agreement acceptable to the City Attorney and a deadline for completion. Council President Keith Saks moved the annexation "subject to an execution of a waiver and development agreement as previously discussed between developer and City and agreement in satisfaction with the City Attorney and that there be a time limit set as to 10 business days starting tomorrow;" the motion was seconded by Council Member Peter Hendricks and carried on a 4‑0 roll‑call vote.

Community Development Director Mark Hofman presented the proposal and applicant representatives John Gaeddert and Scott Thompson responded to council questions about the project design and regulatory compliance. City Attorney Adam King disclosed earlier in the meeting that he, the applicant and Council President Keith Saks had conducted a private site visit the prior week; King recorded that disclosure at the start of the hearing.

Public comment took place before the annexation vote; residents James Kuntz, Tim Hogan and Kimberly Ellwanger addressed the council and applicant counsel Jim Laski replied to those remarks. After returning from an executive session held earlier in the day, the council reconvened and moved forward with the annexation vote and the related land-use approvals.

The annexation approval was linked to several follow-up items: the council directed staff to prepare a zoning ordinance amendment (REZ 2013-03) and to return related ordinance language to the June 10 meeting, and it set a procedural deadline for completion of the required waiver and development agreement documents. The council recorded unanimous support from Council President Keith Saks and Council Members Franz Suhadolnik, Michelle Griffith and Peter Hendricks.
