The board recorded that the project had earlier been classified as an Unlisted action when a use variance was previously sought, and that the ZBA had declared lead agency on Sept. 19, 2023. The City Council later adopted a Negative Declaration on Jan. 24, 2024 and enacted Local Law No. 1-2024 to regulate cannabis retail dispensaries and consumption sites; staff said this Code revision renders the current application a Type II action under SEQRA (6 NYCRR (c)(18)).
