Council clears recorded right-of-way error to allow hotel access in Commerce Center

Vaughn Sexton, an engineering plans examiner, told council that the Commerce Center subdivision recorded a cul-de-sac alignment in 1996 that differs from the constructed road; the actual cul-de-sac was built about 130 feet west of the recorded easement. "This vacation would clean up the right of way to better align with the recorded public right of way within the roadway as constructed," Sexton said, and recommended adopting a resolution to vacate the unused portion to allow K3 Missoula LLC to proceed with a 180-room hotel on Lot 5B.
Council members asked clarifying questions about the recorded map and public benefit; Sexton explained there are no utilities in the proposed vacation area and that the design-review process considered potential public benefits. He also stated the vacated area is approximately "2,214 square feet." The council moved the resolution and approved the vacation in a unanimous roll-call vote.
