Commission hears concerns about Lusby Apartments sale and school-capacity APFO impacts

Commissioners discussed several items of interest. Staff advised that the Lusby Apartments project is listed for sale and that a stamped final plan expires three years after stamping; there is no automatic extension absent a Board of County Commissioners (BOCC) text amendment. "They don't have an extension for the final plan. The final plan, once it's stamped, it expires 3 years from the date that it was stamped," staff said.
Commissioners also reviewed the Adequate Public Facilities (APFO) report for schools. Staff noted Mount Harmony Elementary is at 106% capacity, which under APFO can trigger restrictions on new residential development in that school district. Commissioners discussed whether Board of Education transfer policies that allowed some transfers affected APFO capacity calculations and asked staff to coordinate with the Board of Education on possible approaches.
