"I think the concern with the bid was the price differential on the bid by this particular company that came in so low," Cloche said, explaining HGA's prior recommendation to rebid. Jurors raised questions about the earlier bid cycle, price differences and whether due diligence around bidder qualifications had been satisfied; HGA and staff said they had reviewed the bids and recommended rebid when competition was limited.
