Council authorizes temporary certificate of occupancy for QuikTrip while utility work is completed
Summary
Council voted unanimously to grant QuikTrip a temporary Certificate of Occupancy after staff said the developer met city requirements but the traffic signal installation is delayed by Texas–New Mexico Power.
City staff and economic development officials told the council Jan. 13 that QuikTrip has met building requirements for a fuel sales establishment but cannot fully complete a required signalized intersection because Texas–New Mexico Power (TNMP) has not yet relocated utility lines. Staff recommended allowing a temporary Certificate of Occupancy while TNMP completes its work.
Mayor Travis Magliolo and several councilmembers framed the delay as the utility’s responsibility and said the city should not block a developer ready to operate. Magliolo summarized the position, saying: "The delay is no fault of the developer; the city should not obstruct a business ready to operate." Councilmember Bill Schick raised a broader concern that the Unified Development Code requirement for a signalized corner may impede development if applied rigidly. The council approved the temporary CO 7–0 and directed that the traffic signal be installed once TNMP finishes its part.
