Deputy Chairman Andrew Tejerina convened the Village of Tivoli Planning Board on March 23 and the board opened a public hearing on a proposed accessory building for 47 Montgomery Street.
Village Planner Adriana Beltrani introduced the application and reported the proposed shed would have a 447-square-foot footprint and 894 square feet total including attic space, noting those figures are below the Historic Overlay (H-O) district maximums of 750 square feet for footprint and 1,300 square feet total. The parcel is in the R15,000 zoning district and is within the village's Historic Overlay District.
The board read the village code definition into the record to clarify the plan’s classification: “a building, the use of which is customarily incidental to that of a principal building, and which is located on the same lot as that occupied by the principal building” (Village of Tivoli Code, Chapter 231 Article II Section 4).
Applicants provided supplemental materials. George Smith supplied a sun-angle drawing showing solar orientation at different times of day and year; Amelia Legare read a letter she had submitted to the board and the document was added to the record. Attorney Laurie Heldman of Gordon & Svenson spoke on behalf of neighbor Michele Greig and provided written comments; Greig also addressed the board.
Members of the public raised questions about whether the proposed structure should be treated as an accessory building or instead as an extension of the principal house. The board closed the hearing but accepted additional written comments to be submitted to Clerk Kris Cleaveland through April 6, 2026. The board did not render a final decision on the application at this meeting.
