The Village of Tivoli Zoning Board of Appeals voted unanimously Aug. 4 to grant an area variance allowing a single‑family dwelling at 27 Broadway (parcel 6175-04-622029-0000) to exceed the maximum building width by 4 feet, increasing the permitted width from 48'-0" to 52'-0" to accommodate a first-floor master suite. The board opened the public hearing at 7:02 p.m. and adopted the resolution after deliberation.
Board members found the requested variance would not create a detriment or undesirable change to the neighborhood, noting the proposed design conforms to the Tivoli Pattern Book and other bulk regulations for the R15,000 and Historic Overlay districts. The board characterized the substantiality of the variance as minor (an 8.3% increase beyond the mandatory maximum) and determined the action to be Type II under SEQR, concluding there will be no negative environmental effect. Architect Warren Temple Smith introduced the project to the board and attendees during the public hearing.
Mark Bennett moved to adopt the resolution granting the area variance; Elizabeth Kiefer seconded. Roll call votes were recorded as follows: Karen Cleaveland, aye; Mark Bennett, aye; Elizabeth Kiefer, aye; Bob Zises, aye. The motion carried and the variance was granted. The applicants were advised to appear before the Planning Board for site‑plan review; the next Planning Board dates noted in the minutes are Aug. 11 and Aug. 25, 2025.
The board’s minutes note one certified notice was returned as undeliverable (to 23A Broadway). The action was described in the minutes as "granting an area variance of 4' for parcel 6175-04-622029-0000." No formal conditions or amendments were recorded in the minutes.
